BY ACCESSING OR USING OUR SERVICES IN ANY CAPACITY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS AND ALL APPLICABLE POLICIES. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE PROHIBITED FROM ACCESSING OR USING THE SERVICES.
1. DEFINITIONS AND INTERPRETATION
1.1 Definitions

"B2B Partner" means a business entity that contracts with O8 for corporate fleet services, employee transportation solutions, or other commercial arrangements

"Driver Partner" means a licensed, verified, and authorized independent contractor who provides electric vehicle transportation services through our platform
"Fleet Partner" means a business entity that provides or manages electric vehicles for use on our platform
"Platform" means O8's proprietary technology platform, including our website, mobile applications (iOS and Android), APIs, and all associated digital services and interfaces
"Ride" means any transportation service requested, booked, or provided through the Platform
"Services" means all services, features, applications, content, and products offered by O8
"User" means any individual or entity that accesses or uses the Services, including riders, drivers, business clients, fleet partners, and visitors
1.2 Interpretation
These Terms constitute the entire agreement between you and O8 regarding the Services. Headings are for convenience only and do not affect interpretation. References to "including" mean "including without limitation."
2. ELIGIBILITY AND ACCOUNT REQUIREMENTS
2.1 General Eligibility
To access and use our Services, you must:

Possess full legal capacity to enter into binding contractual relationships

O8 operates a comprehensive electric vehicle mobility platform that connects users with sustainable transportation solutions through advanced technology integration. Our core services include:
Individual Ride Services (B2C): On-demand electric vehicle transportation for personal use
Corporate Fleet Solutions (B2B): Customized electric vehicle fleet services for businesses
Driver Partner Program: Professional driver onboarding, training, and support services
Fleet Management: Advanced vehicle tracking, maintenance, and optimization services
3.2 Service Availability and Limitations
Services are subject to geographic availability, vehicle inventory, driver availability, and regulatory compliance
Service features and availability may vary based on location, time, demand, and operational constraints
We do not guarantee continuous, uninterrupted, or error-free service availability
Booking requests do not guarantee ride confirmation, which remains subject to driver acceptance and operational feasibility
3.3 Technology Platform
Our proprietary technology platform facilitates connections between users and transportation services but does not provide transportation services directly. We act as a technology intermediary connecting supply and demand in the electric vehicle transportation market.
4. FINANCIAL TERMS AND PAYMENT PROCESSING
4.1 Pricing Structure
All rides and services are subject to applicable fees as displayed during the booking process
Pricing may incorporate dynamic factors including demand, distance, duration, time of day, and location-specific variables
Final fare calculations include all applicable taxes, surcharges, and fees
4.2 Payment Methods and Processing
We support multiple digital payment methods including UPI, digital wallets, credit cards, and debit cards
Payment processing is handled through secure third-party payment gateway partners
We are not liable for payment processing issues caused by third-party payment service providers
4.3 Billing and Charges
Charges are automatically processed upon ride completion or service delivery
Pre-authorization holds may be placed on payment methods for pending transactions
Receipt and billing information is provided through the platform
4.4 Refunds and Disputes
Refund eligibility and processing are governed by our Cancellation and Refund Policy
Payment disputes must be reported within 48 hours of the transaction
We reserve the right to investigate and resolve payment disputes in our sole discretion
5. CANCELLATION AND SCHEDULING POLICIES
5.1 User Cancellation Rights
Users may cancel rides through the platform interface
Free cancellation is available within a defined window (typically 2 minutes from booking confirmation)
Cancellation fees may apply after the free cancellation period or when a driver is en route
5.2 Driver Cancellation Rights
Driver Partners may cancel rides for safety concerns, route constraints, or operational reasons
Driver cancellations do not result in charges to users unless the user is at fault
5.3 No-Show Policy
A no-show fee will be charged if a user fails to board the vehicle within 5 minutes of driver arrival at the designated pickup location
No-show determinations are based on driver confirmation and GPS tracking data
6. SAFETY, CONDUCT, AND COMPLIANCE
6.1 Safety Standards and Protocols
All Driver Partners undergo comprehensive background verification, vehicle inspection, and safety training
Users must comply with safety guidelines, including proper seatbelt usage and adherence to vehicle capacity limits
Prohibited activities include but are not limited to: smoking, consumption of alcohol or illegal substances, and engaging in unlawful behavior
6.2 User Conduct Requirements
Users agree to:
Treat Driver Partners and other users with respect and courtesy
Follow all applicable laws and regulations during service usage
Refrain from engaging in abusive, threatening, or discriminatory behavior
Respect vehicle cleanliness and property
6.3 Prohibited Activities
The following activities are strictly prohibited:
Using the Services for illegal purposes or activities
Harassment, abuse, or threats toward Driver Partners or other users
Fraudulent bookings or payment activities
Tampering with or attempting to compromise platform security
Creating false or misleading information
6.4 Enforcement and Consequences
Violations of these conduct requirements may result in:
Account suspension or permanent termination
Legal action where appropriate
Reporting to relevant authorities
Financial liability for damages
7. INTELLECTUAL PROPERTY RIGHTS
7.1 O8 Proprietary Rights
All intellectual property rights in the Services, including but not limited to:
Software, algorithms, and technical systems
Trademarks, service marks, and trade names (including "O8" and associated logos)
Content, graphics, user interfaces, and design elements
Proprietary data, analytics, and business methods
Are owned by or licensed to O8 Blue Sky Logistics Private Limited and are protected under applicable intellectual property laws.
7.2 Limited License Grant
Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purposes.
7.3 User Content and Feedback
You retain ownership of content you provide to the Services
By providing content, you grant O8 a worldwide, royalty-free license to use such content for service operation and improvement
All feedback and suggestions become the property of O8
8. LIABILITY LIMITATIONS AND RISK ALLOCATION
8.1 Platform Nature and Disclaimers
O8 operates as a technology platform connecting users with transportation services. We do not:
Own, operate, or control vehicles used for transportation services
Employ Driver Partners (who are independent contractors)
Guarantee the quality, safety, or legality of transportation services
Assume responsibility for the actions or omissions of Driver Partners
8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
O8 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM
WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
